Math Factor – Terms of Service
The short version
- Math Factor is free to use. You don't need to create an account, but signing up lets you save your progress across devices.
- By using Math Factor, you agree to these terms.
- If you are under 18, you should have the permission of a parent or guardian before signing up.
- We own the content and technology that makes Math Factor work.
- We use your anonymised performance data to improve the app.
- These terms are governed by the laws of New Zealand.
1. Introduction
Math Factor is operated by State Machines Limited (a New Zealand company; "we", "us" or "our"). Math Factor provides an online maths learning platform available at mathfactor.app and related applications and services (collectively, the "App").
These Terms of Service (the "Terms"), together with our Privacy Policy, govern your access to and use of Math Factor. By using Math Factor, you agree to be bound by these Terms. If you do not agree, you must not use Math Factor.
If you are under the age of 18, you should have the permission of a parent or guardian to use Math Factor.
If you are a parent, guardian, or teacher creating or managing an account on behalf of a child or student, you agree to these Terms on their behalf and take responsibility for ensuring their use of Math Factor complies with these Terms.
2. Accounts
2.1 Using Math Factor without an account
You can use Math Factor without creating an account. We will ask for a display name and your age or grade level to set appropriate difficulty levels. Your progress is stored on our servers and associated with a session key stored in your browser. If you clear your browser data or switch devices, you will not be able to recover that progress without a full account.
2.2 Creating an account
When you create an account, you will need to provide a username or email address and create a password. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must not share your login details with anyone else.

2.3 Accounts created by teachers
Teachers and school administrators may create accounts for students in their classes. By creating an account for a student, you represent that you have the necessary authority or consent to do so. The teacher is responsible for ensuring that appropriate consents are in place under the laws applicable to them, and that students are made aware of these Terms.
2.4 Accuracy of information
Any information you provide to Math Factor must be accurate and truthful. You must not impersonate any other person or provide false information.
3. Permitted Use
3.1 Licence
We grant you a limited, non-exclusive, non-transferable licence to access and use Math Factor for personal and educational purposes, subject to these Terms. This includes use by teachers, school administrators, tutors, and tutoring businesses as a tool in the course of providing education or tuition to students — including in a commercial tutoring context. You may not resell or sublicence access to Math Factor itself as a product or service. This licence ends when your account is terminated.
3.2 Intellectual property
Math Factor and all of its content — including questions, exercises, graphics, software, and other materials (the "Content") — is owned by State Machines Limited or its licensors and is protected by copyright and other intellectual property laws. You must not copy, reproduce, modify, distribute, reverse engineer, or create derivative works from the Content without our prior written consent.
We may add, change, or remove Content and features at any time without notice.
3.3 Your data
The performance data generated through your use of Math Factor — including which questions you attempted, your answers, accuracy, and response times — is owned by State Machines Limited. We use and store this data to provide and improve the service, as described in our Privacy Policy.
3.4 Use of results
You agree that we may use the results of your activities on Math Factor — such as which questions were attempted and your accuracy and response times — for research and product improvement purposes. Any such use will be on a fully anonymised and de-identified basis so that the data cannot be linked to you individually. This is described further in our Privacy Policy.
3.5 Prohibited conduct
You must not:
- use Math Factor for any unlawful purpose or in violation of these Terms
- attempt to access another user's account without authorisation
- probe, scan, or test the security of Math Factor or any connected system
- attempt to reverse engineer, decompile, or extract the source code of Math Factor
- upload or transmit content that is defamatory, obscene, abusive, or otherwise objectionable, or that infringes any third party's rights
- scrape, extract, or systematically copy questions, exercises, or other Content from Math Factor by any means, whether automated or manual
- use any automated tools or scripts to interact with Math Factor in a way that disrupts the service or other users
- otherwise interfere with the proper functioning of Math Factor
3.6 Suspension and termination
We may suspend or terminate your access to Math Factor at any time if we reasonably believe you have breached these Terms, if it is necessary to protect the service or other users, or if the service is at risk for any reason including external security events. Where practicable, we will give you advance notice.
You may request deletion of your account at any time by contacting us at privacy@mathfactor.app. Our Privacy Policy describes what happens to your data on account deletion.
4. Fees and Subscriptions
Math Factor is currently free to use. We may introduce paid features or a subscription model in the future. If and when we do, we will give users advance notice and updated terms will apply to those paid features.
5. Disclaimers and Limitation of Liability
5.1 Service provided "as is"
Math Factor is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties or representations — express or implied — about the accuracy, reliability, fitness for purpose, or uninterrupted availability of Math Factor.
Where any condition or warranty is implied by law and cannot be excluded, our liability for any breach of it is limited as set out in clause 5.3.
5.2 Consumer Guarantees Act
Nothing in these Terms limits any rights you may have under the Consumer Guarantees Act 1993 that cannot be excluded by law. However, if you are using Math Factor in trade (for example, as a school or organisation accessing Math Factor for educational delivery), you agree that the Consumer Guarantees Act 1993 does not apply to that use, and you contract out of sections 9, 12A, 13, and 14(1) of the Fair Trading Act 1986.
5.3 Limitation of liability
To the maximum extent permitted by law, our total liability to you for any loss or damage arising out of or in connection with your use of Math Factor — whether in contract, tort, or otherwise — is limited to NZ$100. We will not be liable for any indirect, consequential, or special loss or damage.
5.4 Indemnity
You agree to indemnify and hold harmless State Machines Limited and its officers, employees, and contractors against any claims, losses, or damages arising from your breach of these Terms or misuse of Math Factor.
6. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you — by email if we hold your address, or by a prominent notice in the app — and will endeavour to give reasonable notice before changes take effect. Your continued use of Math Factor after notification constitutes your acceptance of the updated Terms. If you do not agree, you must stop using Math Factor.
7. General
7.1 Privacy
We handle your personal information in accordance with our Privacy Policy.
7.2 Governing law and jurisdiction
These Terms are governed by the laws of New Zealand. You submit to the exclusive jurisdiction of the New Zealand courts for all matters relating to these Terms.
7.3 Entire agreement
These Terms, together with our Privacy Policy, are the entire agreement between you and State Machines Limited relating to Math Factor and replace any prior agreements or understandings.
7.4 Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed, and the remaining provisions continue in full force.
7.5 No waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
7.6 Third party rights
No person who is not a party to these Terms has any right to enforce any provision of these Terms.
7.7 Force majeure
We are not liable for any failure to perform our obligations under these Terms where that failure is caused by circumstances outside our reasonable control, including natural disasters, government action, or internet service disruptions.
7.8 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations — including to a successor in the event of a sale, merger, or acquisition of Math Factor or State Machines Limited — without your consent. If we do so, we will notify you, and any successor will be bound by these Terms and our Privacy Policy.
